This Wannabe 'Better Call Saul' Lawyer Tried To Sue A Student Over A Twitter Prank

Trolling strangers on the internet rarely leads to consequences. Trolling a self-described "alpha male" and "bad ass lawyer," however, landed one college student in court fighting over free speech. Attorney and former Central Michigan University professor Todd Levitt has a local reputation for rabidly defending student clients and fashioning himself in ongoing homage to Saul Goodman, the shady lawyer on "Breaking Bad." When CMU senior Zachary Felton created the parody Twitter account "Todd Levitt 2.0," Levitt made an even bigger name for himself by suing the 22-year-old. Last Thursday, a judge dismissed Levitt's libel and defamation case, issuing an order stating the parody was protected under the First Amendment. "The tweets were meant to ridicule and satirize plaintiff's social media presence in a humorous way," wrote Isabella County Judge Paul Chamberlain, according to the Washington Post. "It is clear that Todd Levitt 2.0 cannot reasonably be interpreted as anything other than a parody account." Read more.

Senators Seek Huge Fines For Colleges Mishandling Sexual Assault

A bipartisan group of senators proposed Thursday to ramp up the federal government's ability to penalize colleges that mishandle sexual assault cases, while imposing significant new transparency requirements. Legislation reintroduced in the Senate, titled the Campus Accountability and Safety Act (CASA), would mandate surveys to obtain a more accurate picture of sexual assault on campus and institute requirements to help guide victims and the accused through potential adjudication. Schools that don't follow federal laws relating to sexual assault could be hit with much larger fines. "The reason why schools are failing is because they do not take this crime seriously," said Sen. Kirsten Gillibrand (D-N.Y.), co-sponsor of the bill, during a press conference Thursday. The senators first unveiled CASA in July 2014 and are now reintroducing it for the new session of Congress. The effort is spearheaded by Gillibrand and Sen. Claire McCaskill (D-Mo.), with Sen. Dean Heller (R-Nev.) as the lead GOP co-sponsor. Chairman Lamar Alexander (R-Tenn.) plans to move the bill through the Senate education committee, Heller said. Read more.

UC Berkeley Built A Parking Garage Right Where Its Students Play Field Hockey

Athletes on the women's field hockey team at the University of California, Berkeley, are considering a lawsuit against the school for taking away their field to build a parking garage without providing a replacement. The field hockey players were told during the fall 2013 semester they would lose their field at the end of the season so the school could build a parking garage. UC Berkeley promised the players a new field, but didn't start construction on it until earlier this month. The university did build a replacement field in spring 2014, but it used the wrong kind of turf. The men's football and lacrosse teams can use that field, and indeed are doing so, but the women's field hockey team has to play on the turf of their rival, Stanford University -- an hour's drive away, on the other side of the Bay Area. Athletes say the extra two hours of travel time per practice has cut into their sleep schedules and forced some of them to drop classes. Plus, the students say, it's degrading to have to play on their rival's home field. Read more.

When did John Travolta become Hollywood's creepy uncle?

Posted: 26 Feb 2015 03:05 PM PST

Middlebrow
By Lauren Duca
Middlebrow is a recap of the week in entertainment, celebrity and television news that provides a comprehensive look at the state of pop culture. From the rock bottom to highfalutin, Middlebrow is your accessible guidebook to the world of entertainment. Sign up to receive it in your inbox here.

What exactly is the space that John Travolta occupies in Hollywood? He’s the second most famous member of Scientology, an aging sex symbol intent on pretending he is not old (or balding), who is marked by trauma and sexual speculation that has spanned decades. After the Oscars on Sunday, it seemed like he thinks of himself as the kind of beloved legend who can engage in wacky antics sans scrutiny (the best example of that sort of figure is Bill Murray). But we don’t have enough space from Travolta's roller coaster of a career to watch him grabbing Scarlett Johansson and Idina Menzel while simply shaking our heads and saying, “Typical Travolta!” When did he become Hollywood’s creepy uncle?

22415mid3

There is this idea, as The Independent pointed out in a 2014 interview pegged to “The Forger,” that Scientology led to the “nadir” of his career. But really, Travolta has been associated with the church since before the height of his fame, and actually credits the religion with his rise. He joined in 1975, starred in “Saturday Night Fever" in 1977 and “Grease” in 1978. “I would say that Scientology put me into the big time,” he said (via the Daily Mail).

It’s impossible to talk about John Travolta rumors without mention of the ones regarding his sexuality. Claims that he is gay are not just relegated to the tabloids. In 2007, with his role as Edna Turnblad in “Hairspray,” they hit the mainstream (and solicited boycotts of the film). “You’d think he must have known, and not cared, that complimenting a writer’s color coordination might seem not just friendly but also really gay,” Jesse Green wrote for the New York Times after Travolta “fondled” his blazer during an interview pegged to the film’s release. In 2014, a lawsuit was filed against Travolta by a man claiming to be his former boyfriend.

"This is every celebrity's Achilles heel," Travolta said about the lawsuit in an interview with The Daily Beast last year. "It's just about people wanting money. That's all. It happens on many levels."

22414mid2

All of that acts as an antithesis to the persona Travolta established onscreen at the start of his fame, specifically -- strategically? -- playing ladies' men in "Saturday Night Fever," "Grease," "Moment to Moment" and "Urban Cowboy." Moviegoers in the '70s had no reason to believe all those characters weren't an extension of Travolta himself, so everything he's done, in some way, has been a response to that.

But the Scientology and sexuality narratives are closely intertwined. With his role in “Hairspray,” the discussion turned to the church’s repressive tactics and how they may have affected Travolta. (In the new Scientology documentary "Going Clear," it's alleged that Travolta won't leave the church because of what it knows about his personal life.) It most certainly should not matter whether he is gay or straight, but Travolta's over-the-top Oscars antics read as performative masculinity. And if this photo isn’t enough evidence for that, consider the fact that he claimed to not be able to remember Idina Menzel’s name back in 2014, because he saw the distractingly “beautiful [and] sexy” Goldie Hawn beforehand.

What’s more interesting is why this absurd (and sexist) behavior does not work for Travolta, while it might in the hands of other aging male celebrities. For explanation there, we look to his career trajectory. Travolta was one of the biggest stars in the world in the late '70s, before a nearly 18-year drop-off. He only returned to something even vaguely resembling his initial level of fame when Quentin Tarantino cast him as Vincent Vega in “Pulp Fiction,” and on some level that felt kitsch. He was the comeback kid at the 1995 Oscars, but his role was a sort of novelty of pop culture: built upon a masculinity that was a play on his public perception and the nostalgia of his dance-heavy rise to fame.

22415mid

The last time we were really talking about Travolta was with “Hairspray” back in 2007. Since then, his life has been racked with trauma -- the loss of his son was followed by an extremely dark period. "Life was no longer interesting to me, so it took a lot to get me better,” he said during an interview at Theatre Royal Drury Lane in London. “I will forever be grateful to Scientology for supporting me. ... They didn’t take a day off, working through different angles of the techniques to get through grief and loss, and to make me feel that finally I could get through a day."

The grip of Scientology on his life is massive, especially when you think about how quickly it spun Tom Cruise out of control and how much earlier Travolta went through the church's auditing process. That combined with the instability of Travolta’s stardom and the grief he’s seen over recent years make him into a decidedly tragic figure. There are objective reasons why grabbing various famous women would be a gross and rapidly meme-ified Oscar moment. Coming from Travolta it represents an eerie desperation that forces us to look at what nearly 40 years in and out of the spotlight has forced our long-lost Tony Manero to hide beneath his wig.

#TBT: Threenager alert

Posted: 26 Feb 2015 02:31 PM PST

This week's featured post from our archive is an all-too-true list from Kristen Hewitt of mommyinsports.com.

10 Signs You Are Living With a Threenager

kristen hewitt

We've all heard of the terrible twos and all the drama of the newfound independence of toddlers. But for some families, the threes can be even more challenging than the previous year. With our first daughter, the age of 3 was a dream, but with our second we've discovered a new phase we're not too pleased about: the threenager.

The threenager is that age when your 3-year-old continually acts like they are going on 13. They have an attitude for miles, a stubborn streak, and want what they want... when they want. Hell hath no fury like a threenager who refuses to nap.

Are you living with a threenager? Here are some tell-tale signs.

1. You live in constant fear of how to cut the shape of their sandwich or toast. Do they want triangles today, rectangles, squares? And when they do tell you, they change their mind right after you cut it.

2. They say things like (with hands firmly placed on hips), "I don't want to clean up, I want to do what I want to do!"

3. You go through three or more wardrobe changes a day. Please just pick a princess already!

4. Your child goes boneless the second you remind them that a transition is coming, especially when they are asked to stop playing. By the way, when was this ability given to children? You know, lay limp and double your body weight so mom can't move you. It's a talent reminiscent of a possum playing dead...

5. They run away from you when it's time to get dressed, or leave a play place, or do anything they deem unnecessary. In fact running away from you is their favorite activity. (Cardio workout?)

6. To nap or not to nap, that is the question. A threenager's answer will always be emphatically "NO!" Unless of course it's time for school, and they crawl into bed because they're "tired."

7. They want three of everything because they are three.

8. At red lights they yell, "Go... GOOO!" Threenagers do not possess patience.

9. Speaking of the car, you have to leave 10 minutes earlier so they can buckle their own car seat by their "OWN SELF!"

10. You realize they'll be a great trial lawyer one day when they've just negotiated their way out of a time-out.

Threenagers can be tough to parent, make you weary, and zap you of all of your patience and energy. But on the flip side, this time can be so completely rewarding. As a threenager's independence blooms, so does their vocabulary, and you sometimes hear lovely things like, "You're my best friend mommy, I love you soooo much, I want to keep you forever!" Yes, a threenager may think you are their pet, but is there anything sweeter than a super tight toddler cuddle?

When did you first realize you were living with a threenager?

The Department of Homeland Security is another day closer to running out of funds, at which point TSA agents will be forced to hold a massive yard sale of everybody's sunblock, mouthwash, and Swiss Army Knives. And asked what he would do about DHS funding, John Boehner blew a kiss at reporters, meaning the speaker has entered the all-too-familiar nonverbal phase of the shutdown drama. This is HUFFPOST HILL for Thursday, February 26th, 2015:

JAMES INHOFE DISPROVES CLIMATE CHANGE WITH MAGICAL SNOWBALL - The Republican chairman of the Senate Environment Committee observed that it is cold outside, therefore scientists are liars. James Inhofe, ladies and gentlemen: "We keep hearing that 2014 has been the warmest year on record. I ask the chair, you know what this is? It's a snowball just from outside here. So it's very, very cold out. Very unseasonable." Inhofe continued: "Some outlets are referring to the recent cold temperatures as the Siberian Express, as we can see with the snowball out there, this is today, this is reality."

NET NEUTRALITY WINS - Dana Liebelson: "The Federal Communications Commission voted Thursday to approve strong net neutrality rules in a stunning decision that defies vocal, months-long opposition by telecom and cable companies and Republicans on Capitol Hill. Democratic Commissioners Jessica Rosenworcel and Mignon Clyburn joined Chairman Tom Wheeler to approve a rule that reclassifies consumer broadband as a utility under Title II of the Communications Act. The FCC intends to use this new authority to ban 'paid prioritization,' a practice whereby Internet service providers can charge content producers a premium for giving users more reliable access to that content. The FCC also intends to ban blocking and throttling of lawful content and services. These regulations also apply to mobile access.

"A few months ago, such rules were considered a pipe dream of net neutrality advocates. Last fall, Wheeler was reportedly still considering a 'hybrid' approach to net neutrality that would have made major concessions to telecom and cable companies, who contend that strong regulations will hinder investment and innovation. But President Barack Obama came out in support of Title II and tough net neutrality rules in November, and Wheeler had to contend with that position as well as millions of comments from the general public in support of net neutrality. Tech start-ups like Tumblr, as well as Silicon Valley giants like Google, also advocated for strong net neutrality rules." [HuffPost]

"When I make decisions, I'll let you know," Boehner said. "That's just a kiss, that's all."

DAILY DELANEY DOWNER - This is what it looks like when a city responds to homelessness by policing bodily functions: "A Fort Lauderdale police officer was 'relieved of duty with pay' Monday afternoon after a video surfaced onYouTube showing the officer pushing and slapping a homeless man at a Broward bus terminal, Fort Lauderdale police confirmed Monday night. 'Relax. I am telling you right now what's going to happen,' he said as Laclair, wearing gray sweats, sat on the ground. 'I'm escorting you out right now. You are not going to go pee. You are not supposed to be here.'" [Miami Herald]

LYNCH NOMINATION CLEARS JUDICIARY - Jen Bendery: "The Senate Judiciary Committee voted Thursday to confirm Loretta Lynch as the next U.S. attorney general, bringing her one step closer to becoming the first African-American woman to hold the post. The panel voted 12 to 8, with all Democrats voting for Lynch. Republicans were split: Sens. Orrin Hatch (Utah), Jeff Flake (Ariz.) and Lindsey Graham (S.C.) supported her nomination, while Sens. Chuck Grassley (Iowa), David Vitter (La.), Jeff Sessions (Ala.), John Cornyn (Texas), Mike Lee (Utah), Ted Cruz (Texas), David Perdue (Ga.) and Thom Tillis (N.C.) opposed her. Senators in both parties have hailed Lynch's qualifications. Hatch described her as 'well-qualified,' and Sen. Dianne Feinstein (D-Calif.) said Lynch has "the character, the determination and the experience to be a strong, independent attorney general.' Lynch's critics all opposed her for the same reason: concerns about her stated intention to defend President Barack Obama's executive actions on immigration." [HuffPost]

Number of llamas who briefly escaped captivity today: 2

Number of CPAC speakers who said "circle jerk" while on the main stage: 1

Left groups are secretly roaming the halls of CPAC, so naturally they outed themselves to us: "[O]n the first day of the conference this year, one of the leading Democratic opposition research groups dispatched its staff to make the trek out to National Harbor, Maryland, in the early hours of the morning. Roaming the halls of CPAC on Thursday were five members of the group, American Bridge. They were wearing attendee badges, meaning they paid for the privilege of being there. And they were wielding cameras, five in all." [HuffPost's Sam Stein]

Also heard at CPAC: "The Senate's slow, guys" - Mia Love

TED CRUZ MAKES HUMOROUS COMMENTS - At one point, Cruz made a crude joke about Bill Clinton, uttering 'youth outreach' when asked by Hannity to play a word-association game about the former president. As for the other Clinton, Cruz had some pre-packaged lines. 'We could have had Hillary here, but we couldn't find a foreign nation to foot the bill,' he said, alluding to a Washington Post story from the day before about donations made to the Clinton Foundation during Hillary Clinton's time as secretary of state." [HuffPost]

OBAMA BEING MACHO ON IMMIGRATION - Elise Foley: "President Barack Obama said Wednesday that Republicans can go after his immigration programs in the courts and in Congress, but his confidence will not be shaken. 'In the short term, if Mr. McConnell, the leader of the Senate, and the speaker of the House, John Boehner, want to have a vote over whether what I'm doing is legal or not, they can have that vote,' Obama said at a town hall in Miami hosted by MSNBC and Telemundo's José Díaz-Balart. 'I will veto that vote because I'm absolutely confident it's the right thing to do.'" [HuffPost]

WALKER FUNDRAISING OFF OF RIGHT-TO-WORK BILL - "Wisconsin Gov. Scott Walker's (R) campaign sent a fundraising email Thursday boasting that he is once again taking on unions and stands ready to sign legislation that would deal a serious blow to labor forces in the state. 'Governor Scott Walker will sign legislation to make Wisconsin a 'Right to Work' state, prohibiting employees from being forced to join a union against their will. It's the right thing to do for job creators and employees alike,' reads the email sent by Friends of Scott Walker, the governor's political arm. 'But you know how it is: It threatens the power the Big Government Labor Bosses crave and they are going to come after him with everything they've got.' The GOP-controlled Wisconsin state Senate approved a right-to-work bill Wednesday, and the measure will now head to the GOP-controlled Assembly, where it's also expected to pass. Walker has promised to sign the legislation when it reaches his desk." [HuffPost]

"Russ Feingold has been reaching out to supporters in recent weeks to discuss a 2016 Senate bid to retake his old seat from Republican Ron Johnson, sources with knowledge of the calls told The Huffington Post. The progressive Wisconsin Democrat was wiped out of the Senate in the tea party wave of 2010, but since then, many supporters have been keeping their fingers crossed that he'd run again -- in a presidential election year likely to be more favorable to Democrats. Multiple sources who spoke on the condition of anonymity told HuffPost that in recent months, Feingold has talked to Sen. Tammy Baldwin (D-Wis.), Milwaukee Mayor Tom Barrett (D) and Rep. Mark Pocan (D-Wis.), among others. Feingold will step down in March from his position as the State Department's special envoy for the Great Lakes Region of Africa, the sources indicated, and can't make an announcement before that. But he toyed with reporters on Tuesday during an event at the U.S. Institute of Peace by referring to his aide, Mary Irvine, as his "once, current and, I hope, future chief of staff."

BOEHNER TELLS KUNCKLESHEADAS TO LAY OFF SELFIES - And those damn selfie branches! Roll Call: "Eleven months to the day after Speaker John A. Boehner reminded members to wear 'appropriate business attire' on the House floor, the Ohio Republican was singing a familiar tune Wednesday. 'Members should wear appropriate business attire during all sittings of the House, however brief their appearance on the floor may be. You know who you are,' Boehner said, a reminder he has issued each of the past three years…'Members should refrain from engaging in still photography or audio or video recording in the chamber,' Boehner said. 'Taking unofficial photographs detracts from the dignity of the proceedings and presents a security and privacy challenge for the House.'" [Roll Call]

1   HISTORY
FCC Turns the Internet Into a Public Utility
The Federal Communications Commission on Thursday voted to change how the Internet is regulated in the most consequential decision of its kind since the Internet's creation. By a 3-2 vote along party lines, FCC commissioners endorsed "net neutrality." Now Internet service providers will be prohibited from creating "fast lanes" for certain content providers, e.g. Comcast speeding up Netflix over YouTube. In layman's terms, the Internet will now be regulated as a public utility along the lines of electricity or water. "The Internet is simply too important to allow broadband providers to be making the rules," Chairman Tom Wheeler said. "This is no more a plan to regulate the Internet than the First Amendment is to regulate free speech." The FCC heard 4 million comments in the lead-up to today's vote.

Post-9/11 Record for No War Casualties
The United States has gone the longest period without a combat casualty since September 11. As of Wednesday, there has not been a combat-related fatality for the past 75 days—the longest stretch since 2002. The figure came up during a heated exchange between a the parent of a veteran killed in Afghanistan and a congressman who will vote on yet another war. Fred J. Boenig questioned Adam Kinzinger's self-described "hawkish" approach to ISIS. "This is no disrespect, but when you said that, the only thing I can hear is a knock on my door again," Boenig said. "I have one question: Do know how many days it has been since the last U.S. casualty? The last military casualty?" Kinzinger did not know.

ISIS Destroys Biblical Artifacts in Iraq
On Thursday, ISIS released a video of its goons ransacking the Mosul Museum and taking sledgehammers and drills to priceless shrines and artifacts. ISIS loyalists have destroyed a number of precious ancient items in Iraq as part of an orchestrated campaign to "eliminate what they view as heresy," according to the AP. The five-minute video also shows a man destroying a carving of an Assyrian deity that dates back to the 7th century B.C. at a nearby archaeological site. ISIS is also believed to have sold some artifacts on the black market to finance its terrorist campaigns. In July, Christopher Dickey warned that ISIS was on the verge of destroying Mosul's collection of biblical artifacts.

A study that claims to be the first to analyze the effects of microscopic air pollutants on people's long-term health found a link between chronic exposure and early death from heart disease. The study analyzed 100,000 middle-age women in California from 2001 to 2007 and found an especially strong link between heart disease and certain components of ultra-fine particles, including exhaust from diesel engines and copper from brake pads. Ultra-fine particles are not regulated by state and federal emissions rules.
